Privacy Notice on the Processing of Personal Data

Dear Data Subjects,
At Başarıarge Energy Technologies Inc., we care about the security of your personal data and we respect your privacy. In this respect, and as required by the Turkish Personal Data Protection Law no. 6698 (“PDP Law”), please find below the information about how and under which conditions we collect and process your personal data, how we take all necessary precautions to prevent data compromise, and the rights you have in connection to your personal data.

1-Identity of the Data Controller

The data controller pursuant to the PDP Law is Başarıarge Energy Technologies Inc., a company that has its head office at the address ‘Güzeltepe Mah., Ahmet Rasim Sok., No:11-3, Çankaya/ Ankara’ (Central Reg. Sys. No. 0145033253100018.

2- Personal Data, Data Collection Methods, Purposes of Processing and Legal Grounds

Your personal data can be collected through different channels depending on the type of relationship you have entered into with our company, as described below, notably visits to our website and requests submitted via the website or by email. In this context, we may collect and process one or more types of personal data such as identity data (Name, Surname, ID number), contact details (address, phone number, email address), educational and professional data (the company you work for, job description, job title, educational status, etc.) and/or visual data (photograph or image).

The processing of personal data is in each case limited to the extent necessary for the conclusion and performance of a contract, establishment and exercise of a right, fulfilment of a legal obligation, and the legitimate interests pursued by the data controller, provided that your explicit consent is obtained in cases that fall under Article 5/2 of the PDP Law.

We may collect your personal through,

• information that we may request within the framework of our activities related to the performance of production, sales, purchasing etc. services offered by Başarıarge Energy Technologies Inc.,
• information you provide to our employees or suppliers verbally, in writing, electronically or on paper forms in order to obtain information about our services,
• business cards given and/or information forms filled out on our website for purposes such as establishing a commercial relationship with Başarıarge Energy Technologies Inc., making or requesting an offer, etc., whether in a physical or virtual environment, face-to-face or at a distance, verbally, in writing or electronically,
• information provided or resumes submitted via employment websites or information forms filled out on our website in order to apply for a job, whether in a physical or virtual environment, face-to-face or at a distance, verbally, in writing or electronically,

We may process the collected data for the following purposes.

Execution of goods / service sales processes, after sales support services, production and operation processes, execution of finance and accounting affairs, execution of company / product / service loyalty processes, execution of customer relationship management processes, execution of human resources and personnel processes, ensuring the security of data controller operations, physical space security, execution of customer satisfaction activities, execution of marketing analysis studies, execution of advertising / campaign / promotion processes, providing information to authorized persons, institutions and organizations, handling of demands / complaints, execution of business activities in accordance with applicable legislation, execution of communication and information security activities

Your personal data obtained before 7 April 2016, the effective date of the PDP Law, in the manner described above or through any other lawful means, are also processed in accordance with the terms and conditions set out herein and stored both in digital and physical environment.

Transfer of Personal Data

Your personal data may be transferred to service providers such as information technology, archive, printing, card printing, distribution companies from which we procure services within the borders of Türkiye and to other third parties that we cooperate with, in each case limited to the extent necessary for the purpose of data transfer, provided that they sign a confidentiality agreement with our company and that any such transfer serves one or more of the abovementioned purposes and complies with the the applicable laws and regulations.

YOUR RIGHTS UNDER THE PDP LAW ARTICLE 11

Pursuant to Article 11 of the PDP Law, you have the right to:

• learn whether your personal data have been processed,
• if yes, request information about it,
• learn the purpose of data processing and whether the data is used for the intended purposes,
• get information about the third parties to whom your personal data is transferred in or outside the country,
• request rectification of incomplete or inaccurate personal data (if any) and request that any such rectification is notified to the third parties whom your personal data have been transferred to,
• request that your personal data be deleted or destructed when the legal reasons for processing have ceased and request that any such deletion or destruction is notified to the third parties whom your personal data have been transferred to,
• object to any outcome to your detriment as a result of your personal data being processed exclusively by automated means,
• request compensation for damage incurred due to the unlawful processing of your personal data.

Requests for the exercise of any of the rights listed above can be submitted in writing by email to info@basarienerji.com, to our KEP address basariarge@hs06.kep.tr or by registered mail to Güzeltepe Mah., Ahmet Rasim Sok., No:11-3, Çankaya / Ankara. (Please be reminded that data subjects’ requests for the exercise of their rights under Article 11 must be made in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller.)
